Motor Compensation Fund
Compensation for people harmed in road accidents involving uninsured or untraced vehicles.
The Motor Compensation Fund is a safety net for victims of motor accidents who would otherwise go uncompensated — for example, where victims are unable to obtain compensation. It helps ensure that innocent road users do not bear the cost of injuries caused by others.
Overview
Every vehicle used on a public road in Ghana must carry at least third-party motor insurance. In practice, some drivers remain uninsured, and in hit-and-run cases the responsible vehicle is never identified. The Motor Compensation Fund exists so that victims in these situations still have somewhere to turn.
The Fund is maintained under the supervision of the National Insurance Commission and is financed by contributions from the insurance industry.
Objective
To compensate people who suffer death or bodily injury in a road traffic accident caused by an uninsured or untraced vehicle, where no valid motor insurance policy responds to the claim.
In doing so, the Fund protects innocent road users and reinforces the importance of compulsory motor insurance.
Governance
The Fund is overseen by a committee constituted in line with the Insurance Act, 2021 (Act 1061), and its administration is subject to the Commission's supervision. The committee sets the rules for assessing and paying claims.
Who can benefit
You may be able to claim if you, or a dependant, suffered injury or death in an accident caused by a vehicle that was uninsured, or by a vehicle that left the scene and cannot be traced.
Claims are generally for death or bodily injury rather than damage to property, and are subject to the Fund's rules and any limits set by the committee.
How to make a claim
Report the accident to the Police and obtain a report. Keep records of any medical treatment and related costs.
Submit a claim to the Commission with the police report, medical evidence and proof of the costs you incurred. The committee assesses the claim and advises on the compensation payable.
